ASMOF Disclaimer

The Council of ASMOF (NSW) reserves the right to decline assistance or provide assistance on a conditional or other basis. In particular, the Council may exercise its discretion in cases where a member requests assistance in relation to an issue which was known to the member prior to joining ASMOF (NSW).
Disputes between members:   ASMOF will strongly recommend that disputes between members should be dealt with by way of mediation. ASMOF reserves the right not to act against other ASMOF members, especially in cases where no ASMOF advice has been sought prior to complaints being made against other salaried practitioners. ASMOF will not assist a member in a dispute with another salaried medical practitioner where the member has been an ASMOF member for less than 12 months (except at the discretion of the Council).

Important Information

Section 274 of the Workplace Relations Act 1996 (Cth), and Regulation 110 of the Workplace Regulations 1996 (Cth) require that applicants be informed of:

  1. The financial obligations arising from membership;
  2. The circumstances and the manner in which the applicant may resign from the organisation.

The following information is provided to fulfill these requirements:

LEVIES The Federal union and the State union rules provide for striking a levy under certain circumstances.
The Federal union rules (rule 14 and rule 24 [3]) gives the power to the Federal Council or Federal Executive. The powerto strike a levy has not been used by the Federal union.
The State registered union rules (rule 6) requires approval of a levy by a General Meeting of members constituted underrule 25. The State registered union has used this power twice since 1927.

RESIGNATION Rules 11 and 12 of the Federal union are set out below:
11 -- Resignation of members
  1. A member may resign membership of the Federation by notice in writing if: the member ceases to be employed in or in connection with the industry of the Federation; or the notice is given not less that three months before the resignation is to take effect and all dues are paid to the date on which the resignation is to take effect.
  2. Notice in writing of resignation shall be addressed to the Branch Secretary of the Branch of which the member resigning is a member and shall be delivered to the office.
  3. A notice of resignation that has been received by the Federation is not invalidated by reason of the fact that it has not been addressed and delivered in accordance with the last preceding sub-rule.
  4. A resignation of membership of the Federation is valid notwithstanding that it is not effected in accordance with this rule if the member is informed in writing, by or on behalf of the Federation, that the resignation has been accepted.
12 -Cessation of membership and associateship
  1. A person shall cease to be a member of the Federation: upon his/her ceasing to be eligible to be a member of the Federation, OR; on the determination by the Branch Council of the branch to which he/she is attached that the membership should be terminated because the member is more than 12 months in arrears for the payment of any dues, levies or other moneys owing by him/her to the Federation or the Branch to which he/she is attached, OR; in the event of his/her being struck off a register of medical practitioners maintained under any law of a State or Territory because of his/her misconduct or default and the Federation council resolves after giving him/her the opportunity of being heard in person or of submitting a written statement that his/her membership should be terminated.
  2. The cessation of a person's membership shall not affect his/her liability (if any) to the Federation or the Branch to which he/she is attached for unpaid dues, levies or other moneys.
  3. An associate of the Federation shall cease to be an associate on the same grounds and in the same manner as a member shall cease to be a member.
38 Resignation
Any member may resign from the Association by giving the Secretary at least one month's notice in writing of his/her intention to do so, and paying all contributions and levies owing by him up to the date of expiration of such notice.
