Review of Statutory Privilege for Root Cause Analyses

RCA questionnaire and discussion paper
Dear Member
Have you been involved with, or do you have a working knowledge of, the root cause analysis process?
If so, the Federation seeks your input in relation to the attached discussion document that has just been released by NSW Health. NSW Health is seeking commentary in relation to whether:
- the current privilege for clinicians should continue to apply or be modified in any way;
- the definition of a 'reportable incident' should be altered;
- the privilege should be extended to those consulted by the rca team eg experts;
- key terms such as 'professional misconduct' should have a unifying definition;
- the rules of natural justice should apply to RCAs;
- RCA teams should be able to communicate with the CE;
- there should be greater clarity around to whom an RCA report must be disclosed;
- there are any ways to improve understanding of the RCA process by clinicians;
- regulations be made setting out the membership of RCA teams.
To make the process easier, included with this is a word document containing all of the questions that have been asked by NSW Health in the attached discussion paper. If you are able to provide useful commentary on these issues, please use the attached word document below to record your views, save it as a new word file and return it to me by close of business on 14 July 2009.
